Terms & Conditions

These Terms & Conditions (“Terms”) form a binding agreement between you and CommuGuard (“CommuGuard”, “we”, “us” or “our”) and govern your access to and use of the CommuGuard mobile application (the “App”), our website at commuguard.co.za (the “Site”) and any related services (together, the “Services”).
By downloading, installing, registering for or using the Services, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
- You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or legal guardian.
- You must provide accurate, current and complete information when registering and keep that information up to date.
- You may only use the Services in compliance with all laws applicable to you.
2. Your account
- You are responsible for safeguarding your login credentials and for all activity under your account.
- Notify us immediately at support@commuguard.co.za if you suspect unauthorised use of your account.
- We may suspend or terminate accounts that violate these Terms, that are inactive for an extended period, or where required by law.
3. Acceptable use
You agree not to:
- Submit false, misleading or fraudulent incident reports or notices.
- Impersonate any person or authority, including councillors, body-corporate officials, municipal employees or SAPS officers.
- Upload content that is unlawful, defamatory, harassing, hateful, obscene, threatening, or that infringes any third party’s rights (including privacy and intellectual-property rights).
- Use the Services to stalk, harass, dox or surveil any individual.
- Attempt to access, scrape, copy or interfere with parts of the Services you are not authorised to access.
- Introduce viruses, malware or any code that could damage or disrupt the Services.
- Reverse-engineer, decompile or attempt to derive the source code of the Services, except to the extent that applicable law permits.
- Use the Services to send spam, unsolicited commercial communications, or for any unlawful purpose.
4. User content
You retain ownership of the notices, messages, incident reports, photos and PDFs you submit (“User Content”). By submitting User Content, you grant CommuGuard a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for technical purposes such as resizing images), distribute and display that User Content solely for the purpose of operating and improving the Services.
You represent and warrant that you have all rights necessary to submit your User Content and that it does not violate any law or any third party’s rights.
We may remove or restrict access to User Content that, in our reasonable judgement, violates these Terms or applicable law, or that is the subject of a legitimate complaint.
5. Authority content and notices
Notices and broadcasts from councillors, body corporates, municipalities, SAPS and other authority users are provided for information only. CommuGuard does not independently verify the accuracy of every notice. In an emergency, always contact the appropriate emergency services directly (e.g. SAPS 10111, 112 from a mobile, or your local emergency number).

7. Intellectual property
The Services — including all software, designs, text, graphics, logos and trademarks (other than User Content) — are owned by CommuGuard or its licensors and are protected by intellectual-property laws. Except for the limited licence granted to you in Section 8, no rights are granted to you in or to the Services.
8. End-User Licence Agreement (EULA)
Subject to these Terms, CommuGuard grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download, install and use one copy of the App on a device that you own or control, solely for your personal, non-commercial use.
8.1 Apple App Store — additional terms
The following terms apply if you downloaded the App from the Apple App Store (“App Store Sourced Application”):
- This EULA is concluded between you and CommuGuard only, and not with Apple Inc. (“Apple”). CommuGuard, not Apple, is solely responsible for the App and its content.
- The licence granted is limited to a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms.
- Apple has no obligation to provide any maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- CommuGuard, not Apple, is responsible for addressing any of your or any third party’s claims relating to the App, including product-liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, CommuGuard, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
- You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
8.2 Google Play — additional terms
If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service.
9. Fees and payments
Basic use of the Services is currently provided free of charge. We may introduce paid features in future; if we do, the applicable pricing and additional terms will be disclosed before you make any purchase.
10. Third-party services
The Services may rely on third-party platforms (such as Google Firebase, mapping providers and SMS gateways). Your use of those third-party platforms is subject to their own terms and privacy policies.
11. Disclaimers
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability, to the maximum extent permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, CommuGuard, its officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or related to your use of (or inability to use) the Services.
Our total aggregate liability arising out of or relating to these Terms or the Services will not exceed the greater of (a) the amounts you have paid to us for the Services in the 12 months before the event giving rise to the claim, or (b) ZAR 1,000.
Nothing in these Terms limits liability that cannot be limited under applicable law, including, where relevant, your rights under the South African Consumer Protection Act, 2008.
13. Indemnity
You agree to indemnify and hold harmless CommuGuard and its affiliates from any claims, damages, losses and expenses (including reasonable legal fees) arising out of or related to (a) your User Content, (b) your use of the Services, (c) your violation of these Terms, or (d) your violation of any third-party right or applicable law.
14. Suspension and termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you breach these Terms or if we reasonably believe such action is necessary to protect the Services or other users. You may stop using the Services at any time and delete your account through our Delete account page.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. You agree that the courts of South Africa have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, except where applicable consumer-protection law grants you the right to bring proceedings in your country of residence.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the “Last updated” date above. Continued use of the Services after an update means you accept the revised Terms.
